Ownership Disclosure: You acknowledge and agree that Manhattan Condo is a brand name and digital property wholly owned and operated by Rikton LLC. Any reference to “Manhattan Condo” within these Terms or on the Site refers to the services provided by Rikton LLC.

2. Ownership and Corporate Disclosure

The website located at www.manhattan.condos (the “Site”) and all associated services, data, and tools (collectively, the “Service”) are a digital property owned and operated by Rikton LLC.

3. No Real Estate Brokerage Relationship

Rikton LLC is a technology and data analytics firm, not a real estate brokerage. The company does not provide legal, financial, or real estate advice. No attorney-client or real estate agent-client relationship is created by your use of the site.

No Licensing: Rikton LLC is not a licensed real estate broker or salesperson. We do not represent buyers, sellers, landlords, or tenants in any capacity.

No Participation in Transactions: We do not negotiate contracts, hold escrow funds, or facilitate the closing of any real estate transactions. Any deal you enter into is solely between you and the other party.

4. Data Accuracy & “As-Is” Disclaimer

Our services aggregate data from various third-party sources including MLS databases, public records, and user inputs.

“As-Is” Basis: All services and data are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.

Accuracy: We do not warrant that property descriptions, pricing, market trends, or analytics are accurate, complete, or current.

Independent Verification: You are strictly responsible for verifying all information such as square footage, zoning, and tax records with a licensed professional before making any financial commitment.

5. Limitation of Liability

To the maximum extent permitted by law, Rikton LLC, its officers, and employees shall not be liable for any loss of profit, loss of data, or cost of procurement of substitute goods or services.

The Company shall also not be responsible for any indirect, incidental, special, or consequential damages.

Errors in calculations, market projections, or “estimated values” provided by our algorithms are not guaranteed to be accurate.

Cap on Liability: In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Rikton LLC from any claims, damages, or expenses including legal fees arising from your breach of these Terms.

This also includes any misuse of the data provided through our services.

You also agree to indemnify the Company from any violation of third-party rights including Fair Housing laws or intellectual property rights.

7. Prohibited Uses

You may not use our data for automated extraction or scraping for the purpose of building a competing product or service.

Our data may not be used to determine an individual’s eligibility for credit, insurance, or employment as defined by the Fair Credit Reporting Act (FCRA).

You may not use lead data obtained through our services for illegal marketing practices including violations of Do Not Call registries or anti-spam regulations such as the CAN-SPAM Act.

8. Intellectual Property

All software, algorithms, data visualizations, and proprietary analytics are the exclusive property of Rikton LLC. Your subscription grants a limited, revocable license for internal use only and does not grant ownership or permission to redistribute our data.

9. Dispute Resolution & Arbitration

Governing Law: These Terms are governed by the laws of the state where Rikton LLC is registered.

Mandatory Arbitration: Any dispute shall be resolved through binding individual arbitration, and you waive your right to a jury trial or participation in a class-action lawsuit.

10. Lead Generation & Referral Disclosure

Rikton LLC provides marketing and data tools that allow users to request information about real estate properties or services. By submitting your contact information through any form on our Service, you acknowledge and agree to the following terms.

Third-Party Routing: You authorize Rikton LLC to share your contact information and inquiry details with our network of Trusted Certified Realtor Partners (“Partner Agents”).

Consent to Contact: By clicking “Submit”, “Get Started”, or any similar button, you provide express written consent to be contacted by Partner Agents via phone, email, SMS, or automated dialing technology even if your number is listed on a Do Not Call registry.

No Endorsement: Rikton LLC does not guarantee the services, qualifications, or legal standing of Partner Agents.

Independence of Partners: Partner Agents are independent contractors and not employees or representatives of Rikton LLC.

Fee Disclosure: Rikton LLC does not charge consumers for connecting them with Partner Agents. However, we may receive a marketing or lead-generation fee from Partner Agents or their brokerage.

11. Telecommunications & SMS Consent

Automated Communications: Partner Agents may use automated technology to contact you. Message and data rates may apply.

Opt-Out: You may opt out of communications at any time by following the “Unsubscribe” or “STOP” instructions provided by the Partner Agent. Rikton LLC is not responsible if a Partner Agent fails to honor opt-out requests after the lead has been transferred.
