Terms of Service

1. The Parties and the Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “You”) and Rikton LLC (together with its subsidiaries, brands, and affiliates, “Rikton,” “the Company,” “We,” “Us”).

The Site: These Terms govern your access to and use of the website located at www.manhattan.condos (the “Site”) and all associated data, tools, and lead generation services provided through the Site.

Ownership Disclosure: You acknowledge and agree that Manhattan Condo is a brand name and digital property wholly owned and operated by Rikton. Any reference to “Manhattan Condo” within these Terms or on the Site refers to the services provided by Rikton.

2. Ownership and Corporate Disclosure

The Site and all associated services, data, and tools (collectively, the “Service”) are the exclusive digital property of Rikton.

3. No Real Estate Brokerage Relationship

Rikton is a technology and data analytics firm, not a real estate brokerage.

No Advice: The Company does not provide legal, financial, or real estate advice. No attorney-client or real estate agent-client relationship is created by your use of the Site.

No Licensing: Rikton is not a licensed real estate broker or salesperson. We do not represent buyers, sellers, landlords, or tenants in any capacity.

No Participation in Transactions: We do not negotiate contracts, hold escrow funds, or facilitate the closing of any real estate transactions. Any agreement you enter into is solely between you and the third-party real estate professional.

4. Data Accuracy & “As-Is” Disclaimer

Our services aggregate data from various third-party sources including MLS databases, public records, and user inputs.

“As-Is” Basis: All services and data are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.

Accuracy: We do not warrant that property descriptions, pricing, market trends, or analytics are accurate, complete, or current.

Verification: You are strictly responsible for verifying all information—including square footage, zoning, and tax records—with a licensed professional before making any financial commitment.

5. Limitation of Liability

To the maximum extent permitted by law, Rikton, its officers, and employees shall not be liable for any loss of profit, loss of data, or cost of procurement of substitute goods or services.

Indirect Damages: The Company shall not be responsible for any indirect, incidental, special, or consequential damages.

Algorithmic Errors: Errors in calculations, market projections, or “estimated values” provided by our algorithms are not guaranteed.

Liability Cap: In no event shall our total liability exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Rikton from any claims, damages, or expenses (including legal fees) arising from:

Your breach of these Terms.
Your misuse of the data provided through our services.
Any violation of third-party rights, including Fair Housing laws or intellectual property rights.

7. Prohibited Uses

You are strictly prohibited from:

Scraping: Using automated tools for data extraction to build a competing product or service.
FCRA Violations: Using our data to determine eligibility for credit, insurance, or employment as defined by the Fair Credit Reporting Act (FCRA).
Illegal Marketing: Using lead data for illegal practices, including violations of “Do Not Call” registries or the CAN-SPAM Act.

8. Intellectual Property

All software, algorithms, data visualizations, and proprietary analytics are the exclusive property of Rikton. Your use of the Site grants a limited, revocable license for internal, personal use only and does not grant ownership or permission to redistribute our data.

9. Lead Generation & Referral Disclosure

Rikton provides marketing and data tools that allow users to request information. By submitting your contact information, you agree to the following:

Third-Party Routing: You authorize Rikton to share your information with our network of Trusted Certified Realtor Partners (“Partner Agents”).

Consent to Contact: By clicking “Submit,” “Get Started,” or any similar button, you provide express written consent to be contacted by Partner Agents via phone, email, SMS, or automated dialing technology, even if your number is on a Do Not Call registry.

Independence: Partner Agents are independent contractors and not employees of Rikton. We do not guarantee their services or legal standing.

Fee Disclosure: We do not charge consumers for this connection. We may receive a marketing or lead-generation fee from Partner Agents or their brokerage.

10. Telecommunications & SMS Consent

Automated Tech: Partner Agents may use automated technology to contact you. Message and data rates may apply.

Opt-Out: You may opt out of communications by following the “STOP” instructions provided by the Partner Agent. Rikton is not responsible for a Partner Agent’s failure to honor opt-out requests after the lead has been transferred.

11. Dispute Resolution & Arbitration

Governing Law: These Terms are governed by the laws of the State where Rikton LLC is registered.

Mandatory Arbitration: Any dispute shall be resolved through binding individual arbitration. You waive your right to a jury trial or participation in a class-action lawsuit.
